I got a Grade A refurb from IBM and was told it should pretty much be as brand new but the battery only last about an hour when not even being used. Surely this isn't right? How long should it last and should I be entitled to a replacement battery if it is too short?

A refurb is a refurb. The battery has been "well used" by the sounds of it. Not much you can do about it, unless they somehow guarantee the battery life or capacity.
